The reservation was only allowed for socially and educationally backward classes by the Indian constitution, but in India, it mainly became caste-based reservation instead of class-based reservation.

Unequal cannot be treated equally’. He further explained that the 50% cap on reservation implemented by the supreme court work only for caste-based reservation and the EWS reservation so they would be impacted by that.

Union social justice and empowerment minister- Thaawarchand Gehlot, stated the similar state laws for EWS quota which were denied by courts as there was no provision for economic reservation in the constitution before. As of now, the law will not be affected by the supreme court if it were to get challenged as it has already been brought by making required provision in the constitution.
