The first question that a person or organization wanting to sue must ask is if he or she has standing to sue. Since the National Enquirer caused the accident and has nothing to gain from suing they will have no say in which court has jurisdiction and hears the case.

Conclusion The case brought against the National Enquirer had a couple of variables. The first question was which state had jurisdiction over the case since the plaintiff lives in California but the National Enquirer is located in Florida.
